Terms of Service

Welcome to Been There. By using our mobile application and website at beenthere.social (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.

You are responsible for maintaining the security of your account and for all activity under your account. You agree to provide accurate information, including a valid phone number for verification. You must not share your account credentials or create multiple accounts.

You retain ownership of content you post (photos, check-ins, reviews, plans). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service. You are solely responsible for the content you post and must have the right to share it.

5. Plans and Sharing

When you create a plan and share it via a link, the plan details (venue name, time, your name, and note) are publicly accessible to anyone with the link. Responses to plans (name and RSVP status) are also visible to anyone with the link. Plans expire after 7 days by default.

6. SMS Communications

By providing your phone number and creating an account, you consent to receive SMS messages from Been There, including verification codes and notifications when friends respond to your plans. Message and data rates may apply. You can opt out of non-essential SMS notifications in your account settings. Reply STOP to any message to unsubscribe from notifications.

7. Third-Party Services

The Service may display information from third-party sources including Google Places, restaurant review sites, and social media. We do not guarantee the accuracy of third-party information. Links to external websites are provided for convenience and do not imply endorsement.

8. Payments and Subscriptions

Certain features may require payment or a subscription. Payments are processed through Stripe. All purchases are non-refundable unless required by law. We reserve the right to change pricing with reasonable notice.

The Service, including its design, logo, features, and original content, is owned by Been There and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that venue information, hours, prices, or ratings are accurate or current. We are not responsible for your experience at any venue discovered through the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Been There shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app or by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York County, New York.
