1. Eligibility
You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.
2. Your account
You're responsible for the security of your account and for all activity under it. Don't share your credentials or create multiple accounts.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, or harm other users
- Post false, misleading, or deceptive content
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Scrape, crawl, or collect data without permission
- Use automated systems to access the Service
- Attempt unauthorized access to any part of the Service
4. User content
You retain ownership of content you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service.
5. Plans, sharing, and the discovery feed
Plans you build in Been There are private by default. When you publish a plan or share its link, the plan's title, venues, times, and any responses become accessible to anyone with the link and may appear in the in-app discovery feed.
The discovery feed surfaces plans authored by Been There editors (labeled as staff), plans shared by people you follow, and other published member plans. If another member remixes your public plan using the "Make it mine" flow, their version is a new plan authored by them — you are not credited as a co-author unless they choose to attribute you.
You can switch any plan back to private from its detail screen, which removes it from the discovery feed and breaks any shared link.
6. Smart search and editorial content
Been There uses Anthropic's Claude language model to power smart search and to summarize editorial coverage of venues. Smart search responses and editorial summaries may contain inaccuracies. Verify time-sensitive details (hours, availability, prices) directly with the venue before relying on them.
7. Third-party services
The Service displays information from third-party sources. We do not guarantee their accuracy. External links are provided for convenience and do not imply endorsement.
8. Subscriptions and payments
Been There offers an optional auto-renewing subscription called BT+:
- Title: BT+
- Length: 1 month, auto-renewing
- Price: $6.99 USD per month
- Free trial: 7 days, then auto-renews unless cancelled.
Cancel any time in Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
9. SMS messaging
Been There operates an A2P (application-to-person) SMS program for account verification, two-factor authentication, and plan-related notifications. By providing your phone number inside the Been There iOS app, you expressly consent to receive SMS messages from Been There at the number provided.
What you'll receive: verification codes when you sign in or enable two-factor authentication; transactional notifications when someone responds to or updates a plan you are part of. We do not send marketing or promotional SMS.
Message frequency: varies based on your activity.
Cost: message and data rates may apply based on your mobile carrier and plan.
Opt-out: reply STOP to any message to unsubscribe at any time. Reply HELP for help, or contact hey@beenthere.social. To re-subscribe, reply START.
Carriers: supported on AT&T, T-Mobile, Verizon, and most regional U.S. carriers. Carriers are not liable for delayed or undelivered messages.
No sharing of mobile data: Been There does not sell, rent, or share your mobile phone number or SMS opt-in consent with any third party for marketing or promotional purposes. Phone numbers are only shared with our SMS delivery provider (Twilio) to deliver the messages described above. See our Privacy Policy for full details.
10. Intellectual property
The Service is owned by Been There and protected by intellectual property laws.
11. Disclaimers
The Service is provided "as is," without warranties. We do not guarantee that venue information is accurate or current.
12. Limitation of liability
To the maximum extent permitted by law, Been There shall not be liable for any indirect, incidental, special, or consequential damages.
13. Account termination
We may suspend or terminate your account if you violate these Terms. You may delete your account any time through the app.
14. Changes to these terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
15. Governing law
Governed by the laws of the State of New York. Disputes resolved in the courts of New York County, New York.
